These Terms and Conditions contain the entire agreement between you and Rivkin Securities relating to your access and use of PushTrade. By accessing and using this service, you agree to abide by the Terms and Conditions.  

About PushTrade

PushTrade is Rivkin’s trading technology that simplifies the investment process. This service sends real-time SMS notifications with buy and sell signals based on the strategies and amounts indicated by the client. After trade order confirmation, PushTrade places the trades in the client's connected stockbroking account.  

Access to Website

This website and the copyright in all text, graphics, images, software and any other materials on this website is owned by the Rivkin Securities Group (‘Rivkin Securities’) or its licensors. You may only use the materials on this website solely for your own personal use and solely for non-commercial purposes. For the purpose of these Terms and Conditions, members of the Rivkin Securities Group and other related companies. You may display on a computer screen or print extracts from this website for the above-stated purpose only and without alteration, addition or deletion. Except as expressly stated within these Terms and Conditions, you may not without Rivkin Securities’ prior written permission alter, modify, reproduce, distribute or commercially exploit any materials from the website. You acknowledge that ‘Rivkin Securities’ and ‘RIVKIN’ are trademarks of Rivkin Securities. You may reproduce such trademarks without alteration on material downloaded from this website to the extent authorised above, but you may not otherwise use, copy, adapt or erase them without Rivkin Securities’ prior written permission. The names and logos of other companies appearing on this website may be the trademarks of third parties and are used by Rivkin Securities with the permission of their respective owners where relevant    

Security and Account authentication

You are responsible for setting your own password and set up your security where you access this application. In accordance with the instructions that are provided to you (which together with your email address are known as your “Account Sign In Details”) as well as keeping all information in your Account confidential. You must notify us immediately if you know or suspect that any Person has accessed or may access your Account, or any information you hold in your Account, without your permission. Unless you notify us otherwise we will treat any activity on or communication made from your Account as having been authorised by you and you may be liable for such activity up to the point of notification. We may need to change or reset your Account Sign In Details to protect you and us against fraud. We will notify you if we do this. You must notify us immediately if you know or suspect that any Person has obtained (or is likely to obtain) your Account Sign In Details and/or has (or is likely to have) access to your Account without your prior approval. When you contact us by phone, you will be required to provide information to us in order for us to authenticate you. You are responsible for making sure that you are able to access our Platform when you need to. This includes having access to a device that can connect to our Platform, maintaining the device so that it functions properly and having adequate internet connectivity. If you cannot access our Platform directly, then you should try to contact our Client Management Team by telephone or email to request assistance. However, this is likely to be much slower than accessing our Platform directly and we cannot guarantee the availability of our Client Management Team. If you have no Positions on your Account for a continuous period of one year, we reserve the right to carry out additional checks on you before we allow you to access your Account or enter into another Trade.    

Checking of Confirmations

You should check all the contents of Confirmations provided to you on the Platform in detail and contact us as soon as possible if you disagree with the contents of a particular Confirmation.    

Order Types

PushTrade orders will be executed as Market Orders or Limit Orders. A Market Order is an instruction to buy or sell a Trade at the first available Buy Price or Sell Price. Market Orders can be used to open or close a Trade. During the Trading Hours for a Product, a Market Order to sell will be executed at the first available Sell Price (for the relevant size of the Order) and a Market Order to buy will be executed at the first available Buy Price (for the relevant size of the Order) as soon as possible after the Order is accepted. Limit Orders will be executed at the price you have confirmed based on the available volume as per our brokers best execution policy. PushTrade is an electronic communication system with your broker, and not a trading platform. You should review your brokers PDS and best execution policy if you would like to know more about trading types and rules apply to our account.   PushTrade will trade only the instruments available in your stockbroking platform. In case a recommendation is not available in your platform, or not applicable (e.g. a CFD recommendation), we will still notify you via SMS.

If you register to become a Customer of Rivkin Securities and receive Services from Rivkin Securities, you will be required to accept, as relevant the Product Disclosure Statement (‘PDS’), Rivkin Securities Stockbroking Terms and Conditions and any other relevant Rivkin Securities Documents and any supplementary and replacement documents and updated information that is provided to you by Rivkin Securities including via emails. Such Terms will govern your relationship with Rivkin Securities and Rivkin Securities’ liability to you in respect of Services provided. Although Rivkin Securities updates the website on a regular basis, it does not warrant that the information or materials contained in the website are current or accurate or that any of products or services featured on the website are available. Rivkin Securities may change the materials appearing on this website at any time without notice. Rivkin Securities is not liable for any damages including, without limitation, damage to your computer or computer system or settings, loss of data, revenue or profits, which you may suffer arising out of your use, delay in using, or inability to access this website, or in any other way connected with this website, including from the downloading of any software from this website. Rivkin Securities disclaims any representation or warranty that the website or materials will meet your requirement or that the website or any software will be uninterrupted, secure or free from errors or viruses.  

Costs

PushTrade is available at no additional cost. It’s included in your regular brokerage fee with affiliated brokers like CMC and SAXO, as outlined in our Financial Services Guide for Domestic & International shares.  

Indemnity

You agree to indemnify and hold Rivkin Securities, subsidiaries, affiliates, officers and employees not liable for any loss, cost, damage, claim or demand, including reasonable legal fees, made by any third party or incurred or suffered by Rivkin Securities or its subsidiaries, affiliates, officers or employees in connection with your use of the website, PushTrade System and any other relevant website in breach of these Terms and Conditions or negligence.
